Model Text of Dispute Resolution Clauses for Hainan Free Trade Port

Article X 【Dispute Resolution】Any dispute arising from or in connection with this contract, both parties shall negotiate amicably; if the negotiation fails, the dispute shall be resolved through the following [  ] way:


1. Ad Hoc Arbitration


The dispute shall be resolved by arbitration, the seat of arbitration shall be Hainan Free Trade Port, and Hainan Free Trade Port Ad Hoc Arbitration Rules shall apply.

Options: a. Hainan Arbitration Association (HNAA); b. Hainan International Arbitration Court (HIAC); c. Hainan Arbitration Center of China International Economic and Trade Arbitration Commission (CIETAC); d. Hainan Arbitration Center of China Maritime Arbitration Commission (CMAC); e. other arbitration institutions registered in Hainan Province.

(4) Other Arbitration Institutions registered in Hainan Province [  ]


The arbitration shall be conducted in accordance with the arbitration rules currently in force of the institution. The arbitral award is final and binding on both parties.
